
Child Custody
The main issue in Child Custody cases is what is in the best interest of the children. There are two types of child custody, joint and sole custody.
Joint custody means that both parents will jointly make decisions regarding the upbringing of their children even if children live with one parent (residential parent). This arrangement is preferred when the parents can agree on issues relating to their children. If the parents cannot agree, or one parent is not suitable for joint parenting for various reasons (drinking, drugs, etc.) the court will award sole custody to one parent.
In both situations the other parent will have some visitation rights, restricted or non-restricted.
