Property Division

Property division is very tricky. It depends whether the property is marital or not. There is a presumption that all property acquired during marriage is marital property unless it is non-marital.

Non marital could be property acquired before marriage, excluded through a pre-marital agreement, received through gift or inheritance, etc. The rule of thumb is start dividing the marital property 50%-50%, unless the facts favor giving more to one side or the other.
