Divorce

What is Divorce?
Divorce is a term used to describe a court process leading to severing the bounds of marriage. Once a court dissolves a marriage, the marriage is over. Divorce is always hard and before deciding to get a divorce, I recommend that parties talk to each other and try to resolve their issues amicably. They should always remember that once they were in love with one another. Things may have changed in their lives, they may have grown apart, someone made a mistake, however, they should still try to respect each other and try to be understanding of the other’s needs and feelings.

Grounds for Divorce
In this State, the most prevalent ground for divorce is “irreconcilable differences”, or no fault divorce. Even if one asks for a no fault divorce, the parties must have lived separate and apart from each other for at least two years, unless they have lived separate and apart from each other for at least six months and they sign an affidavit waiving the two-year period. Other grounds used are mental and physical harassment and abandonment of a marital residence without provocation for at least one year.

Consensual or Non-Consensual Divorce
If the parties agree on all issues, a simple consensual divorce may be had in a couple of weeks provided that grounds for divorce are satisfied (usually a two year waiver would suffice). This is a preferred method, as it saves money, time and emotions. If the parties cannot agree, the divorce will proceed as non-consensual.
